NFT BATTLE ROYALE Terms of Service & Privacy Policy

NFT BATTLE ROYALE is an experimental on-chain NFT game. It is not an investment. It is not financial advice. Participate at your own risk.

1. Who We Are & Scope

NFT BATTLE ROYALE (“NFT BATTLE ROYALE,” “we,” “us,” or “our”) provides a website, interface, and related tools at nftbattle.fun (the “Site”) that allow users to learn about and interact with NFT BATTLE ROYALE, Contenders, $BATTLE, and related on-chain mechanics.

These Terms apply to your use of the Site and any interactions you initiate through the Site or linked third-party platforms. Certain functionality may occur directly on-chain or through third-party services such as OpenSea, wallets, block explorers, RPC providers, or swap interfaces.

NFT BATTLE ROYALE is an experimental project. We do not custody user assets or private keys. Use at your own risk.

2. Acceptance of Terms

By accessing the Site, connecting a wallet, minting a Contender, burning a Contender, entering a Battle, forging a Contender, interacting with $BATTLE, or initiating any transaction related to NFT BATTLE ROYALE, you agree to these Terms and this Privacy Policy.

If you do not agree, do not use the Site or interact with the project.

3. Non-Custodial Design; Your Wallet

All blockchain interactions occur from your self-custodial wallet. We do not take possession of your assets, NFTs, tokens, private keys, or seed phrase.

You are responsible for safeguarding your wallet, private keys, recovery phrase, devices, approvals, and transaction decisions.

Blockchain transactions are generally irreversible once submitted.

4. Platform Description & No Promises

NFT BATTLE ROYALE is an on-chain game experiment involving digital collectibles, token mechanics, burning, forging, Battle entry, and Champion outcomes according to protocol rules.

The Site may display live, delayed, cached, estimated, or placeholder information. Features may change, pause, fail, or be discontinued at any time.

We make no guarantees regarding uptime, availability, functionality, liquidity, Battle outcomes, token value, NFT value, market demand, or future benefits.

5. Contenders, $BATTLE & No Advice

Contenders and $BATTLE are part of an experimental on-chain NFT game. They are not investments, securities, financial products, or promises of future value.

Nothing on the Site is financial, investment, legal, tax, or trading advice. No statement on the Site should be interpreted as a recommendation to buy, sell, hold, burn, forge, enter, swap, or otherwise transact.

You are solely responsible for your own decisions and for compliance with your local laws and taxes.

6. Eligibility; Minors; Acting for Entities

You must be over the age of majority in your jurisdiction and at least 13 years old to use the Site.

If you use the Site on behalf of a company, organization, DAO, or other entity, you confirm that you are authorized to bind that entity to these Terms.

Do not use the Site if you are not legally permitted to do so.

7. Compliance, Sanctions & Prohibited Use

You may not use the Site if you are located in, ordinarily resident in, organized in, or acting on behalf of a person or entity located in a comprehensively sanctioned jurisdiction, or if you are on any applicable sanctions list, including but not limited to OFAC sanctions lists.

You may not use the Site for unlawful activity, fraud, market manipulation, money laundering, malware, Sybil attacks, denial-of-service attacks, exploitation of smart contracts, exploitation of the Site, or any activity that violates applicable law.

We may restrict, block, or terminate access where legally required or where we believe misuse is occurring.

8. Fees, Gas & Programmatic Operations

Blockchain transactions require gas fees and may also involve marketplace, protocol, liquidity, swap, or other fees.

Smart contracts may perform programmatic actions exactly as coded, including but not limited to minting, burning, entering, locking, distributing, forging, swapping, or routing assets.

By transacting, you consent to the effects of the transaction and any associated fees.

9. Game Mechanics & Irreversible Actions

NFT BATTLE ROYALE may include mechanics such as minting Contenders, holding Contenders, burning Contenders for $BATTLE, forging new Contenders with $BATTLE, entering Battles, and resolving Battle outcomes.

Burning a Contender may permanently destroy or remove that NFT from circulation. Entering a Battle may lock or commit a Contender according to the protocol rules. Eliminated Contenders may be burned or otherwise removed according to the mechanics.

You are responsible for understanding the action you are taking before confirming any transaction.

10. Battle Outcomes

Battle outcomes are determined by applicable protocol rules, contract logic, participation conditions, timing, and other on-chain or programmatic factors.

No outcome is guaranteed. No user is guaranteed to become Champion, receive $BATTLE, recover gas fees, profit, or receive any particular result.

Odds, pool information, entrant counts, countdowns, Battle status, and other live values may be estimated, delayed, cached, inaccurate, or subject to change until finalized on-chain.

11. Third-Party Services & Independence

The Site may link to or rely on third-party services, including OpenSea, wallets, RPC providers, block explorers, analytics tools, swap interfaces, hosting providers, or other external platforms.

These services are not controlled by NFT BATTLE ROYALE. Your use of third-party services is subject to their own terms, fees, risks, and privacy policies.

NFT BATTLE ROYALE is not responsible for third-party errors, downtime, listings, delistings, wallet behavior, marketplace behavior, transaction failures, displayed prices, or user losses.

12. Intellectual Property & Open-Source

Unless otherwise stated, Site content, branding, names, logos, visuals, interface design, and related materials are owned by NFT BATTLE ROYALE contributors or their respective owners.

Open-source components, if any, are licensed as stated in their repositories or applicable license files. Use of any open-source code does not imply endorsement by NFT BATTLE ROYALE.

You may not use NFT BATTLE ROYALE branding in a way that suggests endorsement, partnership, or official affiliation without permission.

13. Assumption of Risk; Non-Reliance

Using NFTs, tokens, smart contracts, public blockchains, and on-chain games involves substantial risk.

Risks include but are not limited to smart-contract bugs, exploits, MEV, front-running, failed transactions, irreversible transactions, high gas fees, network congestion, wallet compromise, marketplace issues, liquidity issues, price volatility, regulatory changes, third-party service failures, and user error.

You assume full responsibility for all outcomes. You acknowledge that you are not relying on statements outside these Terms when deciding whether to use the Site or interact with NFT BATTLE ROYALE.

14. No Governance Rights

Holding a Contender, holding $BATTLE, entering a Battle, burning, forging, minting, or otherwise interacting with NFT BATTLE ROYALE does not grant voting rights, governance rights, equity, ownership, revenue rights, profit rights, control rights, or rights to direct the project.

15. Indemnification

You agree to defend, indemnify, and hold harmless NFT BATTLE ROYALE contributors, developers, creators, affiliates, service providers, and related parties from any claim, loss, liability, damage, cost, or expense arising from your use of the Site, your interaction with NFT BATTLE ROYALE, your violation of these Terms, your violation of law, or your infringement of third-party rights.

16. Disclaimers

THE SITE, CONTENT, CONTRACTS, NFTS, TOKENS, GAME MECHANICS, AND RELATED SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NFT BATTLE ROYALE DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AVAILABILITY, ACCURACY, SECURITY, OR ERROR-FREE OPERATION.

17. Limitation of Liability

To the maximum extent permitted by law, NFT BATTLE ROYALE contributors, developers, creators, affiliates, service providers, and related parties shall not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, assets, tokens, NFTs, data, goodwill, or use.

This includes losses arising from failed transactions, gas fees, smart-contract issues, wallet issues, marketplace issues, third-party service failures, inaccurate displayed information, or participation in NFT BATTLE ROYALE.

To the maximum extent permitted by law, aggregate liability is capped at the greater of USD $100 or the amount you paid directly to NFT BATTLE ROYALE for the specific service giving rise to the claim, if any.

18. Changes to the Terms

We may update these Terms at any time. The updated Terms will be posted with a new effective date. Continued use of the Site after updates means you accept the revised Terms.

19. Termination; Survival

We may suspend, restrict, or terminate access to the Site at any time for any reason, including suspected violations of these Terms or applicable law.

Sections that by their nature should survive termination will survive, including disclaimers, assumption of risk, indemnification, limitation of liability, arbitration, governing law, and privacy-related provisions.

20. Governing Law; Arbitration; Class-Action Waiver

These Terms are governed by the laws of Delaware, USA, without regard to conflict-of-law principles.

Any dispute arising out of or relating to these Terms, the Site, or NFT BATTLE ROYALE shall be resolved by binding arbitration under the AAA Commercial Arbitration Rules on an individual basis.

You and NFT BATTLE ROYALE waive the right to participate in class actions, class arbitrations, representative actions, or consolidated proceedings.

Judgment on an arbitration award may be entered in any court of competent jurisdiction. Limited court relief is permitted to seek injunctive relief or to compel or confirm arbitration.

21. Miscellaneous

If any provision of these Terms is found invalid or unenforceable, the remaining provisions remain in effect.

You may not assign these Terms without our consent. We may assign these Terms in connection with project operations, restructuring, or transfer.

Failure to enforce any provision is not a waiver.

These Terms, together with any policies referenced, constitute the entire agreement between you and NFT BATTLE ROYALE regarding use of the Site.

Privacy Policy

NFT BATTLE ROYALE does not seek to profile users, and we do not sell personal information. Public blockchain activity is public by design.

22. What We Process

The Site may process or display:

  • Wallet address and public on-chain activity surfaced when connecting a wallet or interacting with the Site.
  • Technical data from standard web logs, such as IP address, user agent, device type, browser type, pages viewed, timestamps, referrer, and UTM data.
  • Local storage for UI preferences, network settings, or interface state.
  • Support communications if you contact us.
  • Public marketplace, token, NFT, transaction, or blockchain data.

Sources may include you, your wallet, your browser or device, public blockchains, and third-party services.

23. Purposes

We may process data to:

  • Operate the Site and UI.
  • Display transaction status, Battle status, token information, NFT information, or other interface data.
  • Prevent abuse and improve security.
  • Debug performance and errors.
  • Improve the Site experience.
  • Comply with legal obligations.

24. Third-Party Recipients and Processors

The Site may use third-party providers, including hosting, CDN, DNS, security, RPC providers, wallet connectors, block explorers, marketplaces, analytics, embedded charts, and error-logging vendors.

These providers may receive IP addresses, headers, wallet addresses, public blockchain data, and other information necessary to provide their services. Their own terms and privacy policies apply.

25. Legal Bases

Where applicable under EU or UK GDPR, legal bases may include legitimate interests, contract necessity, legal obligations, and consent where required.

Legitimate interests include operating, securing, debugging, and improving the Site.

26. Your Rights

Where applicable, you may have rights to access, correct, delete, port, restrict, or object to processing of your personal information, and to withdraw consent where consent is relied upon.

For California residents, rights may apply under CCPA/CPRA, including rights related to access, deletion, correction, and opt-out of “sale” or “sharing.” We do not sell personal information as commonly understood.

27. Do Not Track

The Site does not currently respond to Do Not Track signals.

28. Children’s Privacy

The Site is not directed to children under 13. If you believe a child provided personal information, contact us so it can be deleted where applicable.

29. International Transfers, Security & Retention

Data may be processed in the United States or other countries. Where required, appropriate safeguards may be used with processors.

We use reasonable measures appropriate to the nature of the Site, but no method is 100% secure.

We retain data only as long as necessary for the purposes described above, unless a longer period is required by law.
